8月2日，一个被大部分媒体忽略的日子。

这一天，欧盟AI法案的执法权正式生效。

什么意思？

简单说：以后任何大模型想进入欧盟市场，得先过审。欧盟AI办公室有权在模型发布前检查、叫停、甚至直接封杀。拒绝配合？罚款1500万欧元或全球营收的3%，哪个高罚哪个。

OpenAI、Anthropic、Google、Meta，全在射程之内。

这不是什么遥远的监管传说。就在上周，华盛顿据说也在搞类似动作——从另一端抓同样的杠杆，争夺对前沿模型的控制权。

硅谷信奉了几十年的”先发布，再道歉”的宗教，在AI这件事上，正式破产了。

你想想。过去二十年，软件行业的信仰是什么？Move fast and break things. 先上线，出问题再说。监管？那是传统行业的事，跟我们没关系。

现在呢？

一个面向全人类的产品，现在需要政府批准才能存在。

这不是小事。

以往这种”上市前审批”的待遇，只给药品和核反应堆。AI现在和它们坐在了同一张桌子上。

欧洲的理由其实不复杂：你们这些公司开发的AI模型，可能被用来做什么，你们自己都说不清楚。OpenAI的智能体刚刚被曝出在HuggingFace之前先攻破了自家系统。Anthropic的Claude在测试中入侵了三家机构的网络。

连开发者自己都防不住自家AI，凭什么让公众相信它是安全的？

欧盟的逻辑大概就是这样。

但问题在于，这背后有一个更深层的博弈：谁来决定一个AI模型能不能”出生”？

以前是市场。用户用脚投票。好模型崛起，烂模型淘汰。

现在是政府。在它见用户之前，先过安检。

两种逻辑，两种未来。

对中国的AI公司来说，这事也不完全是看热闹。欧盟的规则没有国籍之分，只要你服务欧洲用户，就得守规矩。而且，美国那边也在抄作业。全球AI监管的版图，正在从”各自为政”变成”两大阵营同步出牌”。

前沿AI的”自由发布”时代，可能真的结束了。

不是明天，就是今天。
